When you broadcast on Music Wagon, it may be publicly streamed on Facebook. By continuing, you accept the terms below and agree to comply at all times with the Music Wagon user content and conduct policy.

 

When you broadcast on Music Wagon, it may be streamed on Facebook and recorded. At the end of the broadcast, that recording will be automatically uploaded to your Music Wagon account and may replace the live video stream anywhere the live stream was shared. By continuing, you agree that your video is subject to the Facebook terms.

 

Important: You must own, and/or be fully licensed to all of the rights necessary to broadcast (including but not limited to performance rights), any content that is included by you or any participant in any broadcasted Music Wagon stream.

Music Wagon broadcasts – additional terms

IMPORTANT: You are responsible for all content included in a Music Wagon broadcast which you initiate

You are responsible for ensuring all content included in a Music Wagon broadcast initiated by you complies with this Agreement, including content provided by other participants who may join you in the Music Wagon broadcast. Please choose participants you wish to invite to this Music Wagon broadcast carefully, and if necessary stop someone else participating in your Music Wagon broadcast.

Music Wagon is offering you a trial of a feature that allows you to live stream Music Wagon broadcasts (the “Live Content”) through Facebook. The Live Content will also be recorded and automatically uploaded to your Music Wagon account at the end of the broadcast for subsequent viewing (the “Recent shows”). The Archived Content will also immediately replace the live stream so than anyone you have shares the Live Content with will also be able to view the Recent Content.

By using Music Wagon broadcast (the “Service”) you accept and agree to be bound by the Music Wagon’s terms of service, the Facebook terms of service, as well as these additional terms and conditions (the “Agreement”). It is important for you to read each of these documents, as they form a legal agreement between you and Music Wagon regarding your use of the Service.

Live Content

By using the Service you grant Music Wagon a right and license to host, cache, route, transmit, store, copy, modify (to the limited extent technically necessary to perform and operate the Service), stream, publicly perform, communicate to the public, display, reformat, excerpt, analyze, create algorithms based on, and otherwise exploit, use and make available the Live Content (which includes content provided by you or by any other participant in the broadcast, including the sound recordings and compositions embodied therein, if any) worldwide. You agree that this license includes a right for Music Wagon to make such Live Content available to other companies, organizations or individuals with whom Music Wagon has relationships for the provision of syndicated services, and to use such Live Content in connection with the provision of those services. You confirm and warrant to Music Wagon that you have all the rights, power and authority necessary to grant this license.

You are responsible for procuring: (i) all necessary rights, licenses, consents and clearances, including without limitation any payments to recording artists, music publishers, writers, actors, producers, record labels and all other royalty participants arising from Music Wagon’s use and exploitation of the Live Content, and (ii) public performance, synchronization, communication to the public, and making available licenses whether controlled by a local collecting society or otherwise, worldwide. You agree to comply with all applicable laws, rules and regulations regarding live streaming of the Live Content (including content provided by you or by any other participant in the broadcast) worldwide.

Archived Content

The automatic upload of Archived Content to your Music Wagon account is subject to these terms of service and you agree that the Archived Content (which includes content provided by you or by any other participant in the broadcast) will constitute “Content” that has been submitted by you to the Music Wagon broadcasting service for the purposes of those terms of service. To the extent that you have an existing Content License Agreement, Content Hosting Services Agreement or Sound Recording and Audiovisual Agreement with Music Wagon in relation to Facebook (“Facebook Agreements”), you agree that the Archived Content will constitute “Provider Content” in accordance with the Music Wagon Agreements and is subject to the terms of those agreements.

The Archived Content must adhere to the Facebook Guidelines.
